I realized that I didn't need the &> so with just > :

( (3;9) I.@:e.~ {."1) > <"1 ] 4 3 $ ;/i.12

1 3

I see now why it fails with &>... rank 0

( (3;9) I.@:e.~ {."1) &:> <"1 ] 4 3 $ ;/i.12
1 3

( (3;9) I.@:e.~ {."1) @:> <"1 ] 4 3 $ ;/i.12
1 3

try setting 9!:3[2 5 to see their difference.
